{"id":838,"date":"2021-09-20T16:26:00","date_gmt":"2021-09-20T16:26:00","guid":{"rendered":"https:\/\/blog.nicarb.org\/?p=838"},"modified":"2021-10-02T16:56:35","modified_gmt":"2021-10-02T16:56:35","slug":"australia-signs-the-singapore-convention-on-mediation","status":"publish","type":"post","link":"https:\/\/blog.nicarb.org\/index.php\/2021\/09\/20\/australia-signs-the-singapore-convention-on-mediation\/","title":{"rendered":"Australia signs the Singapore Convention on Mediation"},"content":{"rendered":"\n<p>The Australian Government has reinforced its commitment to mediation as a method of international commercial dispute resolution with the signing of the\u00a0<em>United Nations Convention on International Settlement Agreements Resulting from Mediation,\u00a0<\/em>also known as the Singapore Convention.<\/p>\n\n\n\n<p>The Convention establishes a uniform framework for the enforcement of international commercial settlement agreements resulting from mediation.<\/p>\n\n\n\n<p>Attorney-General Michaelia Cash said the signing was a significant milestone for Australia in the development of its international dispute resolution framework, and in increasing access to justice in commercial disputes.<\/p>\n\n\n\n<p>\u201cAccess to enforceable and effective mediation should reduce the time and cost of dispute resolution, thereby enhancing access to justice for individuals and businesses in Australia,\u201d said the Attorney-General.<\/p>\n\n\n\n<p>\u201cA widely adopted Singapore Convention will promote efficiency in the use of judicial resources by encouraging parties to resolve their cross-border commercial disputes outside of courts.\u201d<\/p>\n\n\n\n<p>Minister for Foreign Affairs Marise Payne said the Convention would facilitate international trade and promote mediation as an alternative dispute resolution option in cross-border disputes.<\/p>\n\n\n\n<p>\u201cThe Singapore Convention ensures that privately mediated settlement agreements are able to be readily recognised by law,\u201d Minister Payne said.\u00a0<\/p>\n\n\n\n<p>\u201cSigning the Convention demonstrates Australia\u2019s support for enhanced simplicity, certainty and autonomy for parties in commercial disputes.\u201d The Australian Government will now begin work on implementing the Convention in Australia.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Australian Government has reinforced its commitment to mediation as a method of international commercial dispute resolution with the signing of the\u00a0United Nations Convention on International Settlement Agreements Resulting from Mediation,\u00a0also known as the Singapore Convention.
