{"id":540,"date":"2021-07-15T07:46:00","date_gmt":"2021-07-15T07:46:00","guid":{"rendered":"https:\/\/blog.nicarb.org\/?p=540"},"modified":"2021-07-19T08:02:30","modified_gmt":"2021-07-19T08:02:30","slug":"ask-the-judge","status":"publish","type":"post","link":"https:\/\/blog.nicarb.org\/index.php\/2021\/07\/15\/ask-the-judge\/","title":{"rendered":"Ask the Judge"},"content":{"rendered":"\n<p><strong>Alternative Dispute Resolution<\/strong><\/p>\n\n\n\n<p>In their 1966 hit single, John Sebastian and the Lovin\u2019 Spoonful asked the musical question, \u201cDid you ever have to make up your mind?\u201d<\/p>\n\n\n\n<p>They also asked, \u201cDid you ever have to finally decide and say yes to one and let the other one ride?\u201d<\/p>\n\n\n\n<p>These certainly weren\u2019t legal questions, but if they were and addressed to a judge about making trial decisions in their civil court cases, the answers for the most part would be \u201cno.\u201d<\/p>\n\n\n\n<p>This is because approximately 97% of all civil cases are resolved without a trial primarily because of settlements.<\/p>\n\n\n\n<p>Judges, lawyers, and policy makers understand and promote the idea that fair settlements as early in the legal process as possible, save on expenses, provide certainty, and are in everybody\u2019s best interests.<\/p>\n\n\n\n<p>Even though they aren\u2019t trial decisions, judges make other decisions on these cases which help in the settlement process such as rulings on motions.<\/p>\n\n\n\n<p>Additionally, judges can order the parties to participate in Alternative Dispute Resolution (ADR).<\/p>\n\n\n\n<p>As the name implies this is a procedure, which allows the litigants an alternative to a trial to resolve their disputes.<\/p>\n\n\n\n<p>ADR has existed in different forms for thousands of years and was first used in the United States of America in colonial times having come from England.<\/p>\n\n\n\n<p>Mediation is a process where the parties have a trained neutral mediator to guide them in attempting to reach an agreed resolution of their differences by facilitating communications and finding mutually beneficial solutions.
