RETIRED BUT NOT TIRED, FORMER PC MAURICE MAKHANU NOW A CHAMPION OF ARBITRATION

When civil servants retire, most of them return to their rural homes and wait for nature to take its course.
But Maurice Makhanu, who served the country (Kenya) for 27 years, transferred his skills to the village where he serves as an arbitrator.
Currently, he helps in solving disputes and contributes to the development of Bumula village, which he says has numerous land disputes.
Makhanu acquired his arbitration skills when he worked as an administrator in various parts of the country and when he retired, he converted one of the rooms in his house into an office, just like the one he had as a civil servant. “I thought after my retirement, I would devote my time exclusively to family and leisure but that was never the case,” says Makhanu.

PLEADINGS IN ARBITRATION

In arbitral proceedings, there are basically two ways by which a party is made aware of the case against him or the defense to the allegations he has made against the other party. These are (a) traditional pleadings and (b) statement of case. Traditional pleading is the more formal approach and it is akin to pleadings which are used in court proceedings while statement of case is essentially narrative in form.

DEAL TO END TENSION IN SYRIA’S DARAA REACHED UNDER RUSSIAN MEDIATION

A deal to end the recent tension in Syria’s southern province of Daraa has been reached under a Russian mediation, a war monitor reported.
The deal, reached on Saturday, 31 July, 2021 will see an end to the military showdown in Daraa, where the army and local armed men have been engaged in heavy battles over the past few days, said the Syrian Observatory for Human Rights in a statement.

RELAXATION OF LIMITATIONS FOR FOREIGN ARBITRATORS OR REPRESENTATIVES IN THAI ARBITRAL PROCEEDINGS

In an effort to promote Thailand as an arbitration-friendly venue and a regional hub for international arbitral proceedings, the limitations imposed on foreign arbitrators and representatives who are appointed to act in arbitration proceedings in Thailand have been relaxed.
Previously, foreign parties may have been discouraged from choosing Thailand as the venue for arbitration because of concerns on the limited selection of arbitrators and representatives due to restrictions on foreign arbitrators and representatives. Foreign arbitrators were required to undergo an onerous and time-consuming process to obtain a work permit;
