On the 19th day of February, 2020 the Institute held its second seminar in the year titled “Transparency In an Arbitral Process” with focus topics as (1) ‘’The Tussle between Setting Aside An Award” and (2) the Innuendos Surrounding the Misconduct of an Arbitrator’’.
The speakers included; Mr. Adeleke Agbola – (Principal Partner Cheakley Chambers), Mr. Festus Onyia (Partner Udo Udoma & Belo-Osagie), Mr. Chimezie Victor C. Ihekweazu SAN, FCArb, (Principal, Ihekweazu & Co) and Mrs. Priscilla Ogwemoh, (Managing Partner, Kevin Martin Ogwemoh Legal, and Mrs. Shola Oshodi – John, FCArb, (Registrar/CEO, NICArb).
The seminar provided insight on the importance of transparency in terms of constituting the tribunal, procedures, disclosure of documents and transparency in publication of awards. The speakers also stressed the need for an arbitrator to disclose his relationship (if any) with any of the parties to avoid the award being set aside and to establish transparency. The need to do away with misconduct as a ground for setting aside an award was also highlighted.
